1871 - [ADVERTISEMENT]
To Capitalists & Others - MESSRS PLUNKETT & Co. have received instructions from Mr. McDonough to sell by auction, on the premises, Herbert Street, on TUESDAY next, the 26th instant at 2 o’clock.
The Public House and premises at present occupied by him, situated in Herbert Street in the town of Gulgong., adjoining the stores of Messrs Dickson & Sons, together with the spacious premises in course of erection adjoining the Hotel. The whole standing upon an area of land of 71 feet frontage to Herbert Street, with a depth of 165 feet more or less.
The Auctioneers invite particular attention to the sale of this property, their instructions being to dispose of it to the highest bidder. Situated as it is in a leading thoroughfare and in close proximity to the far-famed Black Lead, it must always command a lucrative trade and ready sale.

1872 - POLICE COURT
Mining of Private Property - Mudgee Police Court - Tuesday June 25th
Before the Police Magistrate, Thomas Cadwell, J.P.
Charles Bland Lowe v Thomas McDonough
Charles B. Lowe stated: I complained of defendant on June 7th, who was trespassing on my private land for the purpose of mining for gold. My land is situated on the Cooyal Creek, in this colony. I have deeds for the property. I did not authorise the defendant either by myself or my agent to work the land.
Cross examined by Mr. Brodribb: The defendant and others pegged out and sank a shaft a considerable distance from the bed of the creek on my private land, as I have been informed it is below the usual flow of the creek. The creek seldom runs. It is only after heavy rains there is water running in it.
Re-examined: I did not see the shaft.
Herbert Alexander Lowe: I am my father’s agent in mining and other matters. I did not give defendant authority to mine gold on my father’s land. I saw the defendant on June 7 working and looking for gold, I saw a shaft on my father’s side. Defendant said, ‘That is mine, we have two now.’
Cross-examined: He was working the centre of the creek. The shaft he pointed out to me as his and the pegs were on my father’s side of the creek. I believe, that he was when I saw him, nearer to Masters’s side than my father’s side of the creek.
Archibald McKechnie: I reside at Gulgong. I have some land rented from Mr. Masters on Cooyal Creek on the opposite side to Mr. Lowe’s. The ground extends down the creek.
Fined 5/-, professional costs, 1 guinea and costs of Court. In default of payment levy and distress.
